Bus Accidents – Who to Sue and Why

While many of us are aware and even consider car and motorcycle accident occupant safety, we rarely think about the numbers in regards to bus accidents and passenger safety. We should.  Studies indicate that the total number of bus accidents have climbed from 9,788 to 28,678 in a four year span ( 2003-2007).  That is a tremendous statistical leap—even car accident cycles do not grow that fast in a few years time.

The FTA (Federal Transit Authority) also indicated that total injuries of bus accidents in the same time period went from 10,998 to 16,388 with kids ranging from 11-14 being among the group most frequently injured.

42 percent of these accidents result from a collision with a car and over half result in severe head injury.

Victims Deserve Financial Compensation

Since bus passengers are not driving they are seldom responsible for their incurred injuries.  This means that in many cases, they deserve reparation for the damage done to their bodies as well as their lives.

The problem that can arise however is who to fault for the crash.  This can be tricky in some cases, especially if the lines are blurred after an investigation where a clear negligent driver cannot be proven.  Insurance companies will often use this fact to haggle and delay payment to the victims.

This of course is unacceptable since the injured will soon find themselves financially challenged as they struggle to pay the mounting medical costs associated with their tragedy.

Determining Liability

This is why it pays to retain the services of a personal injury lawyer as soon as you recognize the fact that the insurance company is not going to play fair.  When your life is unraveling delay tactics will only add insult to injury.

On the other hand, a reputable, seasoned bus accident attorney knows how to play hard ball and get the results you need to make the insurance companies sit up and take notice.

Utilizing their own forensic investigators and reconstructionists they will be able to sort out the details of the collision to see who the responsible party is.  In some cases you may find that both have a shared culpability, at which point you may be able to pursue dual defendants. This increases the likelihood of getting what you need to pay for accrued medical costs and lost wages.

Hit and Run in Santa Ana Leaves One Injured

An early morning two-vehicle accident in Santa Ana left one motorist injured as the other auto driver  fled the scene.  The accident transpired Friday morning around 7 a.m. at the intersection of Bear Street and Segestrom Avenues.   Eyewitnesses indicated that a silver Dodge minivan was traveling northbound on Bear when it collided with a white Oldsmobile that was traveling eastbound on Segestrom.  The minivan rolled over on its side trapping a 59-year-old man and a 17-year-old passenger inside.  The Oldsmobile driver leapt out of his car and fled on foot. Firefighters and paramedics were able to eventually rescue the minivan occupants.  The 59-year-old complained of pain and was immediately taken to a local area hospital; the teenager was unhurt.

Authorities report that it was unclear who was at fault for the collision and that the investigation is ongoing. Bear, Segestrom, Raitt Street and Alton Avenue were all closed for clean up and assessment.

Although the investigation is ongoing one can safely ascertain that the driver who fled has something to hide and that there is a good chance that individual caused the crash.  If that is the finding of police, the injured man will be able to pursue the negligent driver in court for reparation.  Contact us today if you or a loved one has found yourself in just such a predicament.  After a free case assessment our personal injury lawyers will be able to help you acquire restitution for your pain and suffering.  Our Car Accident Lawyers are ready to help you.

The Goal of Personal Injury Litigation

Far too often when people hear about personal injury lawsuits they assume that the individual is only after money.   An example would be the woman who sued McDonald’s for getting leg burns after placing hot coffee between them before peeling out  of drive through.  She won millions  in a subsequent lawsuit although public opinion seemed to indicate that it was foolhardy for the elderly lady to put a hot cup of Joe between her legs in the first place.  The truth is, that this elderly lady had severe 3rd degree burns, required multiple surgeries and will have permanent scars – all because a large corporation decided that they were not going to brew their coffee at the regulated temperatures.  This large corporation acted as if the law did not apply to them.

The perception that America is a litigious society is what primarily drives the idea that all lawsuits in the personal injury arena are without merit.  The reaction has been so knee jerk that it causes a bit of a stigma that makes those who wish to investigate their legal options in this regard a bit hesitant to do so.

Here is what the accident victims needs to consider when approaching the possibility of pursuing personal injury litigation.

  1. Civil tort legislation was enacted to give victims a voice and the ability to pursue wrongdoers in a realm outside of criminal court.  It also gives them the chance to recoup financial restitution in a circumstance where they have lost money due to someone else’s willful negligence. When one thinks about it, this is extremely fair.  Why should someone shell out thousands of dollars in medical related costs and potentially lose their life savings and home because of another individuals thoughtless, criminal, or careless  actions?
  2. Personal injury lawsuits hold the guilty accountable for  the harm they caused to a person or their family.  In some of these cases, criminal law may not apply in regards to the incident itself.  For instance a slip and fall accident may not necessarily land the responsible party in jail, but via a civil lawsuit, the individual or business would have to pay restitution for the victim they hurt.
  3. Personal injury lawsuits act as a deterrent as well.   Even people who have no real regard for their fellow human beings may reconsider foolhardy actions if they know their wallet may be substantially it.  Besides,  If you have been seriously hurt, wouldn’t you desire to protect others so they wouldn’t meet your fate?   If an individual or business puts you in harms way they could very well do the same to others.  The next person may not be so lucky either and could lose their life.

Indeed, there are real and valid reasons why a person may chose to pursue a personal injury case in court.  When they elect to do so, they will require the assistance of a personal injury attorney who understands their legal needs.

Injury Incurred after Hit-and-Run on Freeway

An accident in Santa Ana resulted in an injury today after a felony hit and run transpired.  The incident occurred in the northbound carpool lane on freeway 405 after a green Jeep crashed into the center divider.  The collision was just north of  the Harbor Boulevard exit and  was said to be caused when a vehicle careened towards the jeep. Workplace Injury – Obtaining Compensation

Workplace accidents occur on a daily basis and adversely affect not only victims but their families as well.  Interestingly enough, the amount of worker accidents and fatalities can also affect the United States as a whole.  This is because  workplace injuries amass $125 billion to $155 billion dollars  in medical costs and lost labor estimates.  In regards to fatal injury, 2008 recorded 5,071 accidents where a worker was killed while on the job.

It is for these very reasons that business owners and companies adopt a no-nonsense approach to  safety in the work place, especially since there is link between employee safety and company productivity.  Indeed, any company can observe safety ordinances by learning and strictly adhering to government outlined procedures.

When a company fails to do its job

Some occupations like construction, electrical or off shore oil rig work can be inherently deadly in and of itself.  Even so, there are numerous safety practices that are supposed to be put into place to protect such employees.  Sadly, some companies care more about their bottom line and cut costs in places that may affect their ability to protect workers.

This short sighted response to a financial issue most often than not can result in disaster.  An example of this would be not purchasing protective items like ventilators and goggle for employees who have to handle asbestos.  This can result in the development of a deadly cancer called mesothelioma.  What’s more, a worker’s family members can be placed in danger, as asbestos can attach to clothing and cause illness to anyone who touches them.

The aftermath of injury and death

In the wake of a workplace injury or fatality, associated costs can threaten the financial security of victims and in some instances, leave them without a source of income.  In situations where debilitating injury occurred, medical bills can swallow up saved nest eggs and college funds as family members scramble to adjust both economically and mentally.  When a death occurs, funeral cost can also be tremendously draining as well.  If the individual who died was a primary wage earner,  a family could  become destitute in a very short time and may potentially lose everything.

What families can do

When a loved one dies due to company negligence, surviving relatives can file a wrongful death lawsuit against the company.   If crippling injury occurs, the victim and or their loved ones may also be able to file a personal injury claim.  By taking the matter to civil court, victims and/or their families could recover financial damages that would aid  them in paying for medical related costs as well as any lost earnings.

If you have lost a valued family member or were personally injured in an accident, contact one of our knowledgeable accident attorneys today.  You and your loved one deserve the secure future you worked hard to build.  Call now to set up a free consultation and get the compensation you need to keep your life together after a debilitating accident or tragic loss.

Suspected Drunk Driver Hits Police Officer

A police officer was injured in Chula Vista Thursday Morning after being it by a suspected drunk driver.   The collision occurred on Fourth Avenue near D Street at approximately 12:25 a.m. and happened shortly after the officer placed an apprehended parolee into the backseat of his car.

The vehicle that hit the patrolman was heading south when it drifted into his path and struck him.  The officer’s left foot was run over and the right passenger mirror hit him in the back.  He was taken to the hospital and later released. The 41 year-old-driver was found and arrested shortly after the incident. He will face felony hit and run and driving under the influence charges.

The officer is taking a few off days to get well, but if his foot was damaged badly enough his injuries could be permanent and in time, debilitating.    Then there is the matter of his spine and if the car mirror seriously hurt his back.  Either way, the vehicle driver could be sued in civil court via a personal injury lawsuit.   The officer could then receive financial compensation that would help him  pay for accident  associated medical costs. If you have been similarly injured in a car accident, contact the legal team at Slaughter and Slaughter right away for a free case evaluation.    No one should have to pay financially for someone else’s mistake—get  the law on your side and receive the compensation you need  after your serious accident.

Man Hit by Truck While Sleeping in Park

A 32-year-old Anaheim man was struck by a Park and Recreations pickup while sleeping under a tree in Modjeska Park. The collision occurred around 11:45 a.m. after a maintenance worker cut across the grass to head towards a trash can.  The driver of the truck  said he “felt something” and stopped  the  vehicle to investigate.  It was then that he realized that he had run over a man who had been snoozing under a tree. Investigators are looking into the pedestrian accident to see if there was any way the driver could have avoided hitting the Anaheim resident.  The struck man was alert and did not seem to be seriously harmed in the incident but was transported to the hospital as a precautionary measure.

Hopefully, the medical staff will find nothing wrong with the victim.  If tests indicate he is fine, he can count himself    individual.  As so often happens, a truck accident where a pedestrian or any individual on foot is struck  could result in life altering injury or death.  When that occurs, the accident victim   can file a personal injury lawsuit against the negligent party.
