Drunk Driver Kills Woman on 605 Freeway

A suspected drunk driver struck and killed a 26-year-old Fontana woman on a local highway.  The deceased woman’s car had stalled in Whittier near Waddell Street on the 605 Freeway after she accidentally struck a guard rail on the right shoulder.  The stall occurred at 2:25 a.m. prompting the woman to switch places with a passenger in the back seat when the car was struck from behind by a 1991 Toyota Previa.

The woman, whose name has not been released, was taken to Presbyterian Intercommunity Hospital in Whittier where she died.  The other two passengers suffered mild to moderate injuries and were taken to St. Francis Medical Center in Lynwood.  The driver of the Previa, 20-year-old Criselda Valderrama of Baldwin Park, said she did not notice the stalled car.  She was also taken to a local area hospital and subsequently arrested on suspicion of manslaughter while intoxicated.

More tragic than the youth of the women involved is the fact that the suspect who hit the stalled car was driving while drunk. This could mean that the accident was avoidable and especially senseless.  If she was indeed driving drunk, the deceased woman’s family could sue the offender for financial restitution.  If a drunk driver is behind your loved one’s death, you can file a wrongful death lawsuit.  Contact our legal team for a free case assessment and fight for your rights as well as your dearly departed memory.

Sacramento Man Sues Restaurant for Fatal Crash

Roberto Vellanoweth is serving an 18-year prison sentence for the March 26, 2007 killing of four people while driving under the influence.  The Sacramento man, obviously distraught about the sentence, decided to point the finger elsewhere—at the restaurant that served him drinks.  In the lawsuit, Vellanoweth contends that he went to the Camino Real Restaurant and asked for a “kamikaze virgin” which he thought did not contain alcohol. At the scene of the accident, officials analyzed his blood alcohol level at 0.16 percent which is twice the states legal driving limit.

Vellanoweth admitted to having three martinis’ prior to the visit to the restaurant.  He was convicted of gross vehicular manslaughter while intoxicated.  The lawsuit that was filed in Yolo County Superior Court, stated that the Camino Real “had an obligation not to surreptitiously include alcohol in the punch … without his knowledge or consent.”

As sketchy as this case may be there are many tragic factors that  make it surreal in many ways.  Still, the fact remains that the man had consumed three alcoholic beverages prior to going to the restaurant and they could have hampered him in some way as well.  Whatever the case, four people died in a DUI related incident and their loved ones were left to grieve and mourn.  No matter the circumstance surrounding a DUI case, family members can bring charges against the individual, or establishment, that caused injury or death to a family member.  If a similar incident has happened to you or someone you care about, seek legal action.  Contact us today for a free consultation to learn more about wrongful death lawsuits and get financial reparation for your tragic loss.

Suspected DUI Driver is Stopped with Police Taser

In Fullerton, a man who was suspected of driving under the influence was tased by police when he attempted to flee the scene upon being questioned about possible drug use. The incident occurred Wednesday night at the intersection of Highland and Orangethorpe Avenue at around 7:50 p.m..  39-year-old Robert Castro, the suspect in question, had tossed a meth pipe out of the passenger side window after he was stopped on the 300 block of west Orangethorpe Avenue.

After agreeing to answer questions, the man took off on foot when police took his driver’s license.  Police followed suit and tased him.  Castro was taken to St. Jude Medical center, but was later released.  The man was arrested under suspicion of driving under the influence and resisting arrest.

The story is a two fold tragedy—one that the man was abusing drugs in the first place, and secondly, that he was driving while under the influence of an illegal narcotic.  Had Castro hit a pedestrian or another motorist and caused injuries or a fatality, he would have been held legally accountable.  Thankfully,  the cops were on their job and pulled him over before he had the chance to hurt anyone. Some victims are not so lucky.  If you have been injured or lost a loved one due to the fact that an individual was driving impaired, we can help.  Contact our law offices for a free legal consultation and see what you can do to receive justice after a DUI based accident.

Dram Shop Laws: How They Aid Accident Victims

An obviously inebriated man leaves a bar, hops into his car and gets into a horrific auto accident that results in a fatality. Not only is the man who caused the accident liable, but the bar that served him drinks may be held accountable for the tragic death.

This is due to dram shop legislation, which was established to make bars, taverns and other proprietors of alcoholic beverages take greater responsibility for the actions of drunken clientele. The term dram shop is derived from a Scottish-Gaelic term which refers to a measurement of drink (roughly 1/8 of an ounce or 60 grains). Although a dram can also be attributed to non alcoholic of drinks, the “dram” measurement is largely associated with ales and spirits.

To date, the dram is still related to alcohol and was the decided moniker when the law was set into place.

Controversy and Debate

Although some argue that it isn’t fair to hold a business criminally liable for the actions of adult individuals, the fact remains that drunks cannot make rational decisions. Like any other type of impaired citizen, drunks need to be protected from themselves. Besides, businesses that ply even willing patrons with alcoholic drinks have a legal and moral obligation to make sure their customers do not get behind the wheel of a car when drunk.

If they do,  they should accept partial responsibility when the individual hurts or kills another in a DUI related accident.

Who is Liable?

Dram shop laws can become very specific when it comes to legal liability and may include even social situations, like parties and get togethers.  For instance, if you host a party where drinks are served and allow an obviously drunk guest to leave, then you can be held criminally responsible should they get into a car accident.

Likewise, when an individual that indulged in a bar crawl or similar event  ends up in a DUI related wreck, all  participating bars and taverns that served the person drinks can also acquire criminal liability.  In such cases, fault is determined using comparative negligence.

For example, if one bar only served the man a single drink while another served ten, the latter establishment would have greater culpability than the former.

All of this is to ensure that businesses become more vigilant in preventing impaired individuals from going out into the streets and hurting others.

Advantages for Accident Victims

When people who have lost a loved one look for answers they wish to ensure that all those who are responsible for their valued family member’s wrongful death pay the price. It is not about vengeance but rather, justice.  Society functions best when people understand that we have a responsibility to look out for fellow human beings. Drunk individuals cannot make sound decision and those who serve drinks know that and should  do what they can to help, even if it means calling the police.

Dram shop laws also enables surviving family members to not only pursue all responsible parties so they can receive compensation commiserate with their loss. This is especially important if the deceased individual was a head of household wage earner.

If you have lost a loved one because of the gross negligence of a bar or similar type of business, you have rights!
