A 15-year-old whose name is not being released due to his age,  was believed to be behind the wheel of a Lexus LS400 sedan  that was speeding at 100 mph hour prior to crash that killed  the vehicle’s passenger.  The accident occurred around 1:50 a.m. and fatally wounded a 25-year-old U.S. soldier who was riding in the car.  According to witnesses, the fifteen-year-old and the soldier, both reportedly drunk, left the party to pickup more alcohol from a local store.  The 25-year-old serviceman was identified as Nicholas Clayton, an Army man who was stationed at Ft. Lewis, Washington.  Thrown from the rolled Lexus, he was pronounced dead on the scene after his body was found near the intersection of Camino del Avignon and Niguel road.  The fifteen-year-old was taken to Mission Hospital.

The sedan was registered in the boys parent’s name but authorities don’t know if they knew the teen  was driving the vehicle. The boy is  expected to be booked today on suspicion of vehicular manslaughter.

18-year-old Charged with Murder after Fatal DUI Crash

A teenager who was driving on a suspended learner’s permit and under the influence of alcohol when he crashed into a utility pole,  was charged with murder for killing  a passenger in the car.  Officers say that not only was Milad Moulayi drinking and driving without a legal license, he was traveling at speeds in access of 100 mph.  Milad Moulayi,  was 17 years old at the time of the incident and the victim was 16.

The accident occurred in Aug 2008, after Moulayi departed from his home in followup a party.  The teen had been drinking excessively  but offered to drive his friend, Mackenzie Frazee, home.  After taking his Mercedes Benz up to 102-112 mph, Moulayi crossed the center median on Newport Avenue in Tustin and crashed into a utility pole, splitting the car in half.  The car caught on fire and firefighters had to use the Jaws of Life to free Frazee.  Frazee was pronounced dead at Western medical Center while Moulayi was only treated for cuts and bruises.  His blood alcohol level was registered at .11%.

When young people are involved in a DUI that end another person’s life many people are affected, but for those who have lost a valued family member, there will be no end to their suffering and pain.  There appears to be plenty of blame to go around for this accident—the parents must have not only allowed the teen to drink but to drive their car—or at least left him unsupervised to do so.  The family of Frazee in this case, may have valid grounds for a wrongful death lawsuit.  Has someone’s self centered lawlessness caused the loss of  a loved one?  Then contact the compassionate wrongful death attorneys at Slaughter and Slaughter today for a free consultation.  You may  gain financial reparation for your loss along with the peace of mind that comes when you pursue justice after a senseless tragedy touches your life.

Sacramento Man Sues Restaurant for Fatal Crash

Roberto Vellanoweth is serving an 18-year prison sentence for the March 26, 2007 killing of four people while driving under the influence.  The Sacramento man, obviously distraught about the sentence, decided to point the finger elsewhere—at the restaurant that served him drinks.  In the lawsuit, Vellanoweth contends that he went to the Camino Real Restaurant and asked for a “kamikaze virgin” which he thought did not contain alcohol. At the scene of the accident, officials analyzed his blood alcohol level at 0.16 percent which is twice the states legal driving limit.

Vellanoweth admitted to having three martinis’ prior to the visit to the restaurant.  He was convicted of gross vehicular manslaughter while intoxicated.  The lawsuit that was filed in Yolo County Superior Court, stated that the Camino Real “had an obligation not to surreptitiously include alcohol in the punch … without his knowledge or consent.”

As sketchy as this case may be there are many tragic factors that  make it surreal in many ways.  Still, the fact remains that the man had consumed three alcoholic beverages prior to going to the restaurant and they could have hampered him in some way as well.  Whatever the case, four people died in a DUI related incident and their loved ones were left to grieve and mourn.  No matter the circumstance surrounding a DUI case, family members can bring charges against the individual, or establishment, that caused injury or death to a family member.  If a similar incident has happened to you or someone you care about, seek legal action.  Contact us today for a free consultation to learn more about wrongful death lawsuits and get financial reparation for your tragic loss.

Suspected DUI Driver is Stopped with Police Taser

In Fullerton, a man who was suspected of driving under the influence was tased by police when he attempted to flee the scene upon being questioned about possible drug use. The incident occurred Wednesday night at the intersection of Highland and Orangethorpe Avenue at around 7:50 p.m..  39-year-old Robert Castro, the suspect in question, had tossed a meth pipe out of the passenger side window after he was stopped on the 300 block of west Orangethorpe Avenue.

After agreeing to answer questions, the man took off on foot when police took his driver’s license.  Police followed suit and tased him.  Castro was taken to St. Jude Medical center, but was later released.  The man was arrested under suspicion of driving under the influence and resisting arrest.

The story is a two fold tragedy—one that the man was abusing drugs in the first place, and secondly, that he was driving while under the influence of an illegal narcotic.  Had Castro hit a pedestrian or another motorist and caused injuries or a fatality, he would have been held legally accountable.  Thankfully,  the cops were on their job and pulled him over before he had the chance to hurt anyone. Some victims are not so lucky.  If you have been injured or lost a loved one due to the fact that an individual was driving impaired, we can help.  Contact our law offices for a free legal consultation and see what you can do to receive justice after a DUI based accident.
