Road Design Defects

Head-On Collision Kills One On Twisting Mountain Road

A twisting road with only two lanes could have come into play in a crash that took place in the San Bernardino County mountains on Sunday. A woman identified as Crystal Noreen Salinas, 23, was killed in the accident. Local authorities stated that Salinas was in a Dodge Charger driven by someone else, on Swarthout Canyon Road on Saturday afternoon. The driver, who is also 23, was attempting to pass another vehicle on the road but crashed into another car, a Suburban, in a head-on collision. The driver was also injured, though not fatally, as well as family in the Suburban, who suffered minor injuries.

If you have been the victim in an accident, particularly one ending in a fatality, you may want to take the time to contact a lawyer for help. In a crash like this one, road design defects just may be a legal concern, and are therefore important to consider. Road Construction Accidents in Los Angeles – Know Your Legal Rights

A number of auto accidents occur when the driver suddenly comes upon road construction, and, being unable to stop in time to avoid it, swerves into the adjacent lane, sideswiping the vehicle beside it, forcing it to run into the median barrier or into oncoming traffic with disastrous – even deadly – results. When there is road construction taking place that closes a lane or presents a danger to passing traffic, the construction company or public entity doing the construction or repair must give drivers sufficient warning of the upcoming construction so the cars have sufficient time and distance to change lanes or otherwise avoid the construction.

If the original driver was not given enough warning of the impending construction, he or she may not be legally responsible “liable” and may recover for his injuries and damages as well. However, if the first driver sees the road construction up ahead in plenty of time to change lanes to avoid it, but waits until the last moment and then makes an unsafe lane change that causes the accident, he or she can be held liable for all of the resulting injuries and damages.

This tragic crash occurred on the corner of Foothill Boulevard and Angeles Crest Highway and resulted in two fatalities and left at least three seriously injured.  The deceased have been identified as 12-year-old Angelina Posca and her father Angel Jorge Posca, 58, both from Palmdale, California.

The semi-truck was on a downward grade on Angeles Crest Highway, an area known for being dangerous for trucks.   Numerous truck and big-rig accidents have occured at this very intersection leaving speculation that there may be a possibly road design defect.   It appears that the state has known about this stretch of land and its dangerous condition.

What is more disturbing is that City Officials knew of the dangerous condition that existed.  This was a completely preventable accident.  A copy of a few letters from City Officials to the CalTrans office were obtained by our office.
