Big Rig Strikes Young Los Angeles Brothers

A Los Angeles County truck yard this past weekend was the site of a tragic big rig accident that took two young lives, ages 4 and 15. 15-year-old Joel Flores and his younger brother, 4-year-old Alexander, were riding along a moving truck in Wilmington when they fell off, according to police reports. Reportedly, the two boys were playing in the truck’s rear, seemingly in the cargo area.

After falling, both boys ended in the path of their father’s truck, a big rig tractor trailer. Unaware of the fall, the father advanced the truck towards them, unknowingly striking them.  The older brother, Joel, was pronounced dead at the scene of the truck accident. Young Alexander was transported to hospital in Los Angeles, but unfortunately died later that night from injuries sustained in the accident.

The tragic accident was not intentional and the father is not thought to be at fault. The site of the accident, a Wilmington truck washing facility, is located on a grounds off East Lomita Boulevard past Wilmington Avenue.

Recent S.R. 163 Accident Teaches Valuable Lessons

A 56-year-old San Diego based woman was struck and killed after she attempted to run across State Route 163 just north of Friars Road around 6 p.m. Wednesday evening.  She was struck by a van and died at the scene shortly after her mad dash.

This unfortunate traffic accident, like so many others, could have been avoided.

The tragedy of course was two–fold.  One, that the woman chose to sprint across the highway at all.  Second, that the van could not stop in time to save the woman’s life.

Statically speaking, many pedestrian knockdown accidents that result in death almost always have a two-fold cause.  In most situations, that the pedestrian may not have been paying attention or was taking unnecessary risks in traffic.  On the other hand,  the driver may have been distracted or in a hurry.  When these two forces join, the recipe could spell disaster.

Pedestrian Responsibility

Our mothers always admonished us to look both ways before crossing the street. Sadly, many adults barely look before jaunting over busy roads and highways.  What they fail to understand is that  while pedestrians have the right-of-way, this does not automatically mean car drivers will respect this.  In many cases, a driver feels irritated and frustrated at having to wait for a pedestrian to get across the road.

In other cases, a driver could be distracted or not engaged in lawful driving behavior prior to impact.

Either way, it is the job of the pedestrian to keep him or herself safe.

A good rule of thumb is to always use designated cross walks and sidewalks when and where they are available.  Another good trick is to look both ways twice before crossing the street and to listen out for the  sound of an impending vehicle, which you may hear before you see it coming.

Driver Responsibility

That said, even when a pedestrian is in the wrong a motorist can face serious charges when a death results from a crosswalk accident.  This is largely because a pedestrian legally has the right of way in any and all cases.  A driver also has to show that they were legally observing all traffic rules prior to the collision. If not, they can be held legally liable for serious injuries or death.

Wrongful Death Lawsuit

Of course, there are times when a pedestrian is obeying all traffic rules when they are hit by a negligent, drunk or speeding driver.  When this occurs, family members have the ability to pursue a wrongful death lawsuit against the motorist.
If a loved one has been taken from your family due to driver negligence, you have the right to pursue the matter in court.

Teen Struck While Running across the Street

A fifteen-year-old boy was struck by a car and injured in San Diego today after he attempted to run across the 13500 block of Carmel Mountain road near Defreitas Avenue .  The accident took place in Rancho Penasquitos at around 7:15 a.m.  and caused traffic to be blocked.  The road remained closed until 11 a.m. as authorities investigated the accident.  The youth was rushed to a local area hospital by paramedics, where he was treated for compound fractures to his leg.

A lot of pertinent information is left out that would tell us who may have been truly at fault for the accident. Although we  do know the young man was running across the street,  we do not know if he was doing so inside a crosswalk or even if the walk light had just turned  indicating he could proceed.  Either way, the driver who struck him could face a personal injury lawsuit from the boys parents, especially if negligence was behind the pedestrian knockdown collision.

When a loved one is injured in an accidnet,  get the facts. Car Strikes Pedestrian Crossing Busy Street

An 80-year-old man was struck by a car in Anaheim this evening, blocking traffic at Brookhurst Street and Ball Road.  The accident occurred just after 9 a.m. when a black Acura hit the elderly gentleman as he was crossing the street.  According to eye witnesses, the man had made it halfway across Brookhust walking west at roughly 100 years north of the intersection when he was hit. The elderly gentleman was not in a crosswalk when he was run down by the Acura.  The pedestrian was taken to UCI Medical Center but the extent of his injuries are not currently known.

While many people will point to the fact that the injured man was not in the crosswalk, the reality is pedestrians always have the right of way no matter what.  That aside, only a real investigation will indicate if the injured man had true culpability in the accident.  The case could be made that the Acura was speeding and could have had time to stop if the driver was obeying posted limits.  If this is true, the injured man and/or family members may be able to pursue a personal injury lawsuit against the motorist.

If you or a loved one has been injured in a  pedestrian knockdown accident, take action by seeking legal representation.  You may just receive compensation for your injuries and bring the perpetrator to justice.  Call us today for a free consultation and see how the law firm of Slaughter and Slaughter can help you facilitate your personal injury claim goals.

The victim died at the scene.  The sports car driver was not arrested although an investigation into the incident is ongoing.

This tragedy may seem open and shut, but many times investigations can reveal a shocking chain of events that turn the case around.  Authorities could learn for example, that the driver had been recklessly speeding and may have had time to stop and avoid killing the woman.  If this is the case, surviving family members could  file a wrongful death lawsuit against the motorist.

Man Hit by Truck While Sleeping in Park

A 32-year-old Anaheim man was struck by a Park and Recreations pickup while sleeping under a tree in Modjeska Park. The collision occurred around 11:45 a.m. after a maintenance worker cut across the grass to head towards a trash can.  The driver of the truck  said he “felt something” and stopped  the  vehicle to investigate.  It was then that he realized that he had run over a man who had been snoozing under a tree. Investigators are looking into the pedestrian accident to see if there was any way the driver could have avoided hitting the Anaheim resident.  The struck man was alert and did not seem to be seriously harmed in the incident but was transported to the hospital as a precautionary measure.

Hopefully, the medical staff will find nothing wrong with the victim.  If tests indicate he is fine, he can count himself    individual.  As so often happens, a truck accident where a pedestrian or any individual on foot is struck  could result in life altering injury or death.  When that occurs, the accident victim   can file a personal injury lawsuit against the negligent party.
