Santa Monica Farmer's Market Pedestrian Accident

State appeals court ruled that the victims of the farmers markets tragedy in Santa Monica can sue the city of Santa Monica for railing to adequately provide protection to shoppers at the 3rd Street Promenade weekly market.

A Los Angeles Court Superior Judge had previously ruled that the city of Santa Monica had legal immunity from being sued.

The tragic accident left 10 people dead and 63 injured when George Weller, age 86 crashed his car into shoppers and pedestrians on July 16, 2003. His car plowed through wooden sawhorses which were used as barricades. The National Transportation Safety Board found that the sawhorses were inadequate and the city of Santa Monica did not meet the national, state or city guidelines.

Comparative Negligence Defined

In many jurisdictions, states use the doctrine of comparative negligence to determine whether the plaintiff can recover for damages even though the plaintiff themselves were partially negligent.

By using a comparative negligence standard, the statutes may provide for apportionment of damages between the two parties at fault. For example if the total damage is $100.00 and Plaintiff is 40% at fault and Defendant is 60% at fault then the plaintiff is entitled to $60.00.

There are generally two forms of comparative negligence: Partial and pure comparative negligence. In a partial comparative negligence jurisdiction, most states will bar a recovery for the plaintiff if the plaintiff’s negligence was more than (51%) the negligence of the defendant.

In California, the comparative negligence standard was not adopted by statute but rather by a judicial decision. Under the judicial decision, California applies pure comparative negligence, which states that even if the plaintiff’s negligence exceeds the negligence of the defendant, the plaintiff may still recover the apportionment of damages. For example if total damage is $100.00 and plaintiff is 70% at fault and defendant 30% at fault, then plaintiff is entitled to $30.00.

Negligence Per Se Defined

Negligence per se is defined as a violation of a code, statute, law, ordinance or regulation, and that the violation results in an injury in which it was created to prevent. The individual injured must be one that the statute or law was designed to protect.

California Evidence Code section 669(a) states: "The failure of a person to exercise due care is presumed if: (1) He violated a statute, ordinance, or regulation of a public entity; (2) The violation proximately caused death or injury to person or property; (3) The death or injury resulted from an occurrence of the nature which the statute, ordinance, or regulation was designed to prevent; and (4) The person suffering the death or the injury to his person or property was one of the class of persons for whose protection the statute, ordinance, or regulation was adopted."

Negligent Entrustment Defined

Nelgigent entrustment is defined as when a person is liable for injuries proximated caused by entrusting one's property in the hands of someone he knows or should have known will use it in a manner that is unreasonable and will pose a serious risk of harm to others.

When doing an analysis using negligent entrustment, the focus is generally on the forseeability of the harm. Was the harm a foreseeable risk? This does not focus on the particular injury but rather on the defendant's conduct and whether it was likely to result.

Automobiles
Negligent entrustment of automobiles happens to be one of the most common forms of negligent entrustment. Some examples would be an owner who allows an intoxicated driver use the car; a father who allows his son borrow a his car, and is aware that his son has been in several recent car accidents.

Firearms
Negligent entrustment can apply in any instance where an owner of a potentially dangerous product allows another to borrow it. This includes firearms. However, a stolen gun from a gun cabinet cannot meet the elements for negligent entrustment.

Strict liability is a legal doctrine that imposes liability without fault. Strict liability allows an injured person to recover for damages and compensation regardless of negligence or fault. Some activites are so dangerous that even the use of utmost care to prevent harm does not remove the risk of harm completely.

Strict liability may apply in cases where people or companies engage in abnormally dangerous activities or ultrahazardous activities. If the hazardous activity causes you harm, injury or damages, the person, persons or company that are engaged in the hazardous activity are liable no matter how careful they were, or what measures they took to prevent any harm.

Animals: Strict liability may apply to common household animals such as dogs as well as wild animals and circus animals such as tigers and elephants. If a dog owner knows of their dogs dangerous past behavior or the dog has previously bitten someone, the dog owner may be strictly liable for the dogs actions. On the other hand, if a circus elephant escapes from a circus that has taken every precaution to prevent the escape, the circus may be strictly liable because of the wild nature of the elephant.

Airplanes: Commercial flights and common airplanes used by consumers to travel are no longer considered hazardous or ultrahazardous activity. Since flying is so common, the courts decided it can no longer be considered as a strict liabililty issue. Outside of the common airplane, test planes, experiental planes and other noncommercial planes may be considered as ultrahazardous activity.

Blasting: Blasting is a common law school scenario used to explain the effects of ultrahazardous activity. Today, blasting within a city or near other buildings that would foreseeably be harmed may be consiered ultrahazardous activity. If the blasting is outside of the city, then strict liability may not apply.


Product Liability
: Typically, for strict liability to apply in a products liability case, the plaintiff must show:
1) The product is unreasonably dangerous;
2) product caused injury while being used in a way it was intended to be used; and
3) product was not changed from the condition in which it was originally sold.
Typically, you cannot bring a claim for a defective product under strict liability if you knew about the defect and continued to use it. Defective products can arise from: foreseeable risk of harm, negligent design, failure to warn, unsafe product, warranty of merchantibility (Uniform Commercial Code), fitness for a particular purpose (Uniform Commercial Code), implied warranties, express warranties,
