Fatal Motorcycle Accident in Elk Grove California on Grant Lane Road

The month of May 2008 is recognized as Motorcycle Safety Awareness Month. Unfortunately, we are once again reminded of the tragic reality that most drivers do not see or pay close enough attention to recognizing the motorcyclist on the roads. This morning at around 6:45am, another fatal motorcycle accident occurred in Elk Grove, California just south of Sacramento.

A driver of a Toyota Prius was attempting to turn onto Grant Lane Road from Sloughhouse Road. While he was waiting for traffic to clear before turning onto the road, the driver did not see the motorcycle on the road accelerated and went into the lane of traffic where he realized the motorcycle approaching. It was too late.

The CHP preliminary investigation noted that the driver of the Prius to be at fault for a right-of-way violation, failure to yield to oncoming traffic. The investigation however, is not finalized and will continue.

The motorcyclist was a 37-year-old Rancho Cordova man who was pronounced dead at the scene of the accident.

Motorcycle Accident on Sunset Blvd. Near Brentwood

On Friday afternoon, a motorcyclist was killed on Sunset Blvd. near Brentwood. The motorcycle was struck by a dump truck and the biker was trapped by the truck’s wheels and died on the scene. Sunset Boulevard was closed for nearly 5 hours as police and emergency crews responded to the motorcycle accident. The LA Times reported that the victim was a 40 year-old-man from Santa Monica.

The accident took place on Sunset Blvd, west of the 405 underpass. Tragic accidents like this require proper and thorough investigation into the causes of the accident. Police and investigation crews shut down Sunset Blvd to conduct their investigation.

May 2008 Named Motorcycle Safety Awareness Month

In order to help encourage drivers to practice safe driving and recognize motorcyclist, Slaughter & Slaughter is joining numerous local organizations and other federal, State and local highway safety, law enforcement, and motorcycle organizations to proclaim May 2008 as “Motorcycle Safety Awareness Month.”

Motorcycle fatalities now account for 11 percent of total road fatalities and have increased each year from a low of 2,116 in 1997 to 4,810 in 2006. So while there has been continued success in reducing vehicle deaths in recent years, this progress is being negatively affected by the rise in motorcycle fatalities which has more than doubled

Motorcyclists are much more vulnerable than passenger vehicle drivers in the event of a crash. Research shows that approximately 80 percent of motorcycle crashes injure or kill a motorcycle rider, while only 20 percent of passenger car crashes injure or kill a motor vehicle driver or passenger.

10 Things All Car & Truck Drivers Should Know About Motorcycles

1. There are a lot more cars and trucks than motorcycles on the road, and some drivers don't "recognize" a motorcycle; they ignore it (usually unintentionally). Look for motorcycles, especially when checking traffic at an intersection.

2. Because of its small size, a motorcycle may look farther away than it is. It may also be difficult to judge a motorcycle’s speed. When checking traffic to turn at an intersection or into (or out of) a driveway, predict a motorcycle is closer than it looks.

3. Because of its small size, a motorcycle can be easily hidden in a car’s blind spots (door/roof pillars) or masked by objects or backgrounds outside a car (bushes, fences, bridges, etc). Take an extra moment to thoroughly check traffic, whether you're changing lanes or turning at intersections.

4. Because of its small size a motorcycle may seem to be moving faster than it really is. Don't assume all motorcyclists are speed demons.

5. Motorcyclists often slow by downshifting or merely rolling off the throttle, thus not activating the brake light. Allow more following distance, say 3 or 4 seconds. At intersections, predict a motorcyclist may slow down without visual warning.

6. Turn signals on a motorcycle usually are not self-canceling, thus some riders, (especially beginners) sometimes forget to turn them off after a turn or lane change. Make sure a motorcycle's signal is for real.

7. Motorcyclists often adjust position within a lane to be seen more easily and to minimize the effects of road debris, passing vehicles, and wind. Understand that motorcyclists adjust lane position for a purpose, not to be reckless or show off or to allow you to share the lane with them.

8. Maneuverability is one of a motorcycle's better characteristics, especially at slower speeds and with good road conditions, but don't expect a motorcyclist to always be able to dodge out of the way.

9. Stopping distance for motorcycles is nearly the same as for cars, but slippery pavement makes stopping quickly difficult. Allow more following distance behind a motorcycle because it can't always stop "on a dime."

10. When a motorcycle is in motion, don't think of it as motorcycle; think of it as a person.

California Motorcycle Helmet Law

In 1992, the California legislature enacted a law that required all motorcycle riders to wear a helmet. As of 2006, only three states (Colorado, Iowa and Illinois) do not require motorcycle riders to wear a helmet. Check to see California’s bicycle helmet laws as they differ in requirements.

Wearing a helmet may make a difference when filing a claim for recovery for injuries as a result of your motorcycle accident in California. For example, if you were wearing a helmet, but your injury was not in the head or neck area, the helmet may be insignificant. Since you still would have been injured regardless of the helmet, generally this will make no difference in your claim. On the other hand, if you were wearing a helmet and you suffered an injured to the head or neck area, the fact that you were wearing a helmet may make a difference in your claim (see comparative negligence). Since California requires all motorcycle riders to wear a helmet, if you suffered a head, neck or brain injury as a result of a motorcycle accident and you were not wearing a helmet, it will be very difficult to recover since this may establish comparative negligence.

The National Highway Traffic Safety Administration reported that in 2004, 4,008 motorcyclist were killed in traffic accidents with 46% of the fatalities being the age of 40 or older. The NHTSA also reports that motorcycle deaths have increased by 89% from 1997 – 2004.

Each year, the month of May has been designated as Motorcycle Safety Awareness Month. Each state uses this month to promote safe motorcycle riding. Wearing the proper protective gear including helmets, padding, footwear, eye protection and gloves can help prevent injury and possible fatalities.
