An innocent motorist was killed in Anaheim Monday evening after a suspect who was fleeing police plowed through an intersection against a red-light and crashed into two cars. The chase began after police, who were responding to a domestic violence call, noticed a pick up truck parked in a nearby lot.  They approached the vehicle and the suspect took off.  The police followed in hot pursuit, pursuing the pick-up as it blazed into the intersection of Magnolia and Crescent Avenues. The suspect’s vehicle  then crashed into two cars at around 8 p.m.

One of the vehicles was propelled into a nearby apartment building; the victim was killed on impact.   The suspect’s truck was thrown 100 yards and tipped on its side.  The individual was taken to a local area hospital in critical condition.

As reported earlier in the week, a man that was known throughout his Norwalk neighborhood as a Good Samaritan who helped feed the homeless, was struck by a car after he attempted to rescue a suicidal woman.  The man, a Mr. Charles Bybee, died Friday from his injuries.  He was 62 years old.

Bybee was struck by the vehicle at around 9 p.m. Monday evening in the 1100 block of West Orangethorpe Avenue, and was taken to the UC Irvine Medical Center.  He  was later pronounced dead at 2:42 a.m. Friday morning. The rescued woman is herself unharmed and is being detained at a mental facility, where she is receiving treatment.

One could assume that  man of this type of temperament would be glad to know the woman he saved is okay, but the loss is devastating for the community as well as his family.  This is why surviving loved ones should look into the possibility of pursuing a wrongful death lawsuit, if at all possible.  Such cases can look very cut and dry but may have many legal implications that need to be worked out with a professional. If someone you loved was lost in  a similar tragedy, get the law on your side.  Contact one of our wrongful death attorney’s today and set up a free consultation. We will go over your case and see what we can do to bring closure and justice  to you and your beloved family member.

You’re minding your own business, when all of a sudden you are rear ended by another driver.  You soon find yourself at the hospital where you learn that your injuries may be permanent.

Sounds like an impossible scenario but unfortunately, it plays out thousands of times a year all over the country.  Adding insult to injury is the fact that most people may shy away from the idea of pursuing the guilty for damages in court.

There could be many reasons for this, but the top two are.

  1. Fear that the can’t afford a personal injury attorney – This is changing a bit, but there are still some people who don’t realize that most personal injury lawyers will take a case on for a contingency fee.  This means that you won’t have to pay any upfront fees. In some cases, you won’t even have any accumulated costs  unless you win.
  2. They feel that they contributed to the accident – in at least 13 states, comparative negligence laws allow injured individuals to collect financial damages even if they are in, some small way, responsible.  A jury usually decides the case, dividing fault into percentages.  The percentage in which you are at fault can affect the financial award but you can recover something for your accident.

Despite these fears, a car accident victim would benefit greatly from investigating their options.  Below are few of the reasons why they should.

  • Medical costs – most serious wounds incurred via an automobile accident could take intensive treatment and care.  Rehabilitation and personal therapy may also be necessary to help individuals who received brain or spinal injury and the costs could triple.  Add to it in home care costs and prescriptions and one can see their savings dwindle to next to nothing, which leads to our next topic…
  • Financial Security – Although a nest egg is supposed to be set aside for emergency situations, one can drain their bank accounts in little to no time after an accident.  This can threaten all aspects of your life, including your home and the kid’s college funds.  In the end, you and your family’s economic future could land on shaky ground, a worry you won’t need as you try to heal.
  • Negligent Motorist Should Pay – People who have a flagrant disregard for the law will hardly ever alter their behavior unless they are made to suffer severe penalty.  Besides, the worst case scenario is that the careless driver harms another innocent victim, only this time the person dies. Holding someone financially responsible for their behavior makes them more apt to be careful next time around. It also creates a record of behavior that will increase their penalty should they make the same choices in the future.

Six people were injured in Long Beach today after a fiery five car collision that closed the eastbound section of the Artesia Freeway (91).   At least one individual was critically injured and taken to an area hospital for medical treatment after the wreck.  The auto accident occurred between Cherry Avenue and Paramount Boulevard., around 4:50 a.m. and involved several automobiles.

One of the cars caught on fire shortly after impact and Long Beach firefighters were sent to the scene to extinguish the flames. Firemen also had to rescue a couple of individuals who were trapped in their cars.  Paramedics arrived on the scene and treated most of the injuries on site—one person was taken to the hospital in critical condition.

While the cause of the crash is unknown, the outcome is unmistakable—people were injured and one of them rather seriously. In the wake of the accident, fault will be assigned and someone will be held accountable for damage sustained during the collision.  Accident victims will then be able to obtain compensation for their suffering. If you have been involved in a similar accident, don’t hesitate to contact one of our personal injury lawyers. Via a free consultation, we will be able to assess your case and help put you on the road to obtaining the money you deserve and the medical treatment you need.

In personal injury cases—such as automobile collisions, motorcycle accidents, slips and falls, and the like—your lawyer gets paid only from the settlement or jury award that the attorney gets for you. You pay nothing up front or as you go along. The personal injury lawyer representing the injured party works on a “contingency fee” basis: He or she takes a percent of the settlement or award he or she manages to get for you. If the case goes to trial and the jury finds that the other party was not at fault (not “negligent”) and therefore does not have to pay a dime for your injuries, you do not owe the attorney anything for his or her legal services and representation of you.

The percent of the fees the attorney is entitled to generally depends upon at what stage of the lawsuit the case settlement. If the case settles before a formal complaint is filed with the court, the fee may be smaller than if the case settles after the complaint is filed. And the attorney’s fees may go up another level after a trial date is set. Generally, attorney’s fees are 33% of the recovery the attorney gets for you before the trial date is set and 40% after the trial date is set. While you may think these figures are high, studies show that injured victims receive more money in their pockets when they are represented by a lawyer than if they try to handle the matter itself. While you might be able to negotiate a minor fender bender on your own, for more serious injuries and death cases, you need to be represented by an experienced personal injury lawyer who will work his or her hardest to get you the highest amount for your injuries or loss.

In Fullerton, a man who was suspected of driving under the influence was tased by police when he attempted to flee the scene upon being questioned about possible drug use. The incident occurred Wednesday night at the intersection of Highland and Orangethorpe Avenue at around 7:50 p.m..  39-year-old Robert Castro, the suspect in question, had tossed a meth pipe out of the passenger side window after he was stopped on the 300 block of west Orangethorpe Avenue.

After agreeing to answer questions, the man took off on foot when police took his driver’s license.  Police followed suit and tased him.  Castro was taken to St. Jude Medical center, but was later released.  The man was arrested under suspicion of driving under the influence and resisting arrest.

The story is a two fold tragedy—one that the man was abusing drugs in the first place, and secondly, that he was driving while under the influence of an illegal narcotic.  Had Castro hit a pedestrian or another motorist and caused injuries or a fatality, he would have been held legally accountable.  Thankfully,  the cops were on their job and pulled him over before he had the chance to hurt anyone. Some victims are not so lucky.  If you have been injured or lost a loved one due to the fact that an individual was driving impaired, we can help.  Contact our law offices for a free legal consultation and see what you can do to receive justice after a DUI based accident.

A motorcycle crash on Pepper Street shut down traffic for two hours on the eastbound section of Interstate 10 in Colton.  The accident was reported at 3:48 a.m. and the driver was killed.  Details are minimal at best and the accident itself is being investigated.

It would appear that this was a single vehicle accident, i.e., no one else was involved.  Even so, there could be  numerous reasons why the cyclist crashed, barring driver error.  For example, unpaved roads, an obstruction in the roadway, or even defective motorcycle parts, could be among the primary reasons why the driver wrecked.

Before making any assumptions, family members should look into the incident to see if there were any underlying causes of the crash itself.  For instance, they may find that the make and model of the bike is prone to brake failure or engine lock up.  If so, they would need to inspect the motorcycle to see if it was functioning properly.  If defective auto parts are the culprit, the family would be able to file a wrongful death suit.  Has something like this happened to you or your family?  Then contact us for a free case evaluation and see what you can do to bring those responsible for your loved one’s death to justice.
